4. The 6th FDI Moot Asia-Pacific Regional Rounds

 

Seoul, Korea | 21 - 24 August 2018

The Korean Commercial Arbitration Board (KCAB) is holding the 6th FDI Moot Asia-Pacific Regional Rounds with Center for International Legal Studies (CILS) and Seoul National University School of Law.

Increasing international investment, the proliferation of international investment treaties and contracts have contributed to the development of international law that defines obligations between host States and foreign investors and refers to internationalized arbitration procedures for resolving related disputes. The FDI Moot addresses such investment disputes.

The 2018 FDI Moot case considers how a new government has suspended the extraction of a rare earth, for which a foreign investor held the sole mining concession. The suspension was based on a study showing increased health risk in the nearby population. The suspension, confiscation of rare earths already prepared for export and customers’ contract terminations led the investor to shut down its operations, only then to discover government plans to license extraction by another investor.

In this regards it is really urgent now for Indonesia to review/revise arbitration law (Law No. 30/1999) in particular with regard to international arbitration to make it more in line with the international arbitration law and practices. Rise of International Commercial Arbitration and Developments In Investment Treaty Arbitration: ASIA’S RESPONSE

In October 2016, BANI Arbitration Centre of Indonesia has the honor to host the APRAG Conference. The theme of the conference is “the Rise of International Commercial Arbitration and Developments in Investment Treaty Arbitration: Asia’s Response.” This theme is taken because Asia in particular and other regions in the World have witnessed the tremendous growth of international commercial arbitration. This rise is an interesting development but also a challenge especially for the arbitration institutions in the Asia.

In addition, the regions have also witnessed the growth of investment arbitration disputes and how the countries in disputes have shown their resistance to the investor-state dispute settlement (ISDS) mechanism. This is shown among others by a number of countries, which have taken a hostile response to ISDS. A number of countries have shown their position not sign the investment treaty and plan to cancel or not to renew their bilateral investment treaties containing ISDS.
